NEW COMPUTER LIMITED WARRANTY AND SUPPORT


SUMMARY:

WARRANTY:
Your new computer comes with a one year in home/office Limited Warranty. This means that if there are any defects in the physical components in your new computer, Raven Computer Services will come to you to repair/replace the defective part and get your computer back in operating condition again. This may require us to take your computer back to our shop to complete testing and repairs, meaning you could be without a computer for a time, even though warranty repairs get our highest priority. Of course, we can only cover things that we have control over, so there are some exceptions.

Some things this Limited Warranty does NOT cover:

 • YOUR DATA AND SETTINGS.   Under no circumstances is Raven Computer Services responsible for your data or for the settings on your computer. You, the  owner of the data, are solely responsible for proper backups of your data and settings. We suggest you back up your data frequently! Computer components can and do fail. Some diagnosis and repair procedures can damage data. BACK IT UP FREQUENTLY, BEFORE PROBLEMS ARISE! Raven Computer Services can suggest a back up regimen and a disaster recovery plan if you need help in this area.
VIRUS INFECTIONS.   Many virus or other types of malicious software infections can cause hardware to fail. If failure is caused by an infection, the repairs made will not be under warranty.
OVERCLOCKING.   Overclocking the computer, or making any other similar setting changes to the computer will immediately void all warranties.
VOLTAGE SPIKES.   Raven Computer Services recommends that your new computer be hooked up to a properly working Uninterruptible Power Supply in order to protect it from voltage spikes and drops, as well as outages. Any damages caused by not being hooked up this way, or by a failure in the UPS, will not be covered under this warranty.
SOFTWARE.   Software is provided “AS IS”.

MORE DETAILS:

Except as expressly set forth in this limited warranty, Raven Computer Services (RCS) makes no other warranties or conditions, express or implied, including any implied warranties of merchantability and fitness for a particular purpose. RCS expressly disclaims all warranties and conditions not stated in this Limited Warranty. Any implied warranties that may be imposed by law are limited in duration to the Limited Warranty period.

RCS warrants that the original hardware product and all the internal components of the product that you have purchased from RCS are free from defects in materials or workmanship under normal use during the Limited Warranty period. The Limited Warranty period starts on the date of purchase and extends for one calendar year. This Limited Warranty extends only to the original purchaser of this RCS computer, and is not transferable to anyone who obtains ownership of the RCS computer from the original purchaser.

RCS computers are manufactured using new materials. Replacement parts may be new or equivalent to new. Replacement parts are warranted to be free from defects in material or workmanship for thirty (30) days or for the remainder of the Limited Warranty period of the RCS computer in which they are installed, whichever is longer.

During the Limited Warranty period, RCS will repair or replace the defective component parts or the hardware product. All component parts or hardware products removed under this Limited Warranty become the property of RCS. The replacement part or product takes on either the Limited Warranty status of the removed part or product or the thirty (30) day limited warranty of the replacement part. In the unlikely event that your RCS computer has a recurring failure, RCS, at its discretion, may elect to provide you with a replacement unit of RCS’s choosing that is at least equivalent to your originally purchased RCS computer. RCS reserves the right to elect, at its sole discretion, to give you a refund of your purchase price instead of a replacement. This is your exclusive remedy for defective products.

YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE DATA STORED ON YOUR HARD DRIVE OR OTHER STORAGE DEVICES AS A PRECAUTION AGAINST POSSIBLE FAILURES, ALTERATION, OR LOSS OF THE DATA. BEFORE TURNING OVER ANY UNIT FOR SERVICE, BE SURE TO BACK UP DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION. RCS IS NOT REPSONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. RCS IS NOT REPSONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY RCS WHEN THE COMPUTER WAS MANUFACTURED.

RCS does not warrant that the operation of the product will be uninterrupted or error-free. RCS is not responsible for damage that occurs as a result of your failure to follow back up or disaster recovery instructions.

RCS must be informed of any possible warranty claims DURING THE LIMITED WARRANTY PERIOD. Claims made outside of the Limited Warranty period will be void, even if claimed that defects occurred during the Limited Warranty period.

RCS must be granted access to the computer in order to effect warranty repairs.

This Limited Warranty does not extend to any product from which the serial number has been removed or that has been damaged or rendered defective (a) as a result of accident, misuse, abuse, or other external causes: (b) by the use of parts not manufactured or sold by RCS: or (c) by modification or service by anyone other than RCS.

These terms and conditions constitute the complete and exclusive warranty agreement between you and RCS regarding the RCS computer you have purchased. These terms and conditions supersede any prior agreements or representations – including representations made in RCS sales literature or advice given to you by RCS or an agent or employee of RCS – that may have been made in connection with your purchase of the RCS computer. No change to the conditions of this Limited Warranty is valid unless it is made in writing and signed by an authorized representative of RCS.

LIMITATION OF LIABILITY

IF YOUR RCS COMPUTER FAILS TO WORK AS WARRANTED ABOVE, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE REPAIR OR REPLACEMENT. RCS MAXIMUM LIABLITY UNDER THIS LIMITED WARRANTY IS EXPRESSLY LIMITED TO THE LESSER OF THE PRICE YOU HAVE PAID FOR THE PRODUCT OR THE COST OF REPAIR OR REPLACEMENT OF ANY HARDWARE COMPONENTS THAT MALFUNCTION IN CONDITIONS OF NORMAL USE.

RCS IS NOT LIABLE FOR ANY DAMAGES CAUSED BY THE COMPUTER OR THE FAILURE OF THE COMPUTER TO PERFORM, INCLUDING ANY LOST PROFITS OR SAVINGS, OR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. RCS IS NOT LIABLE FOR ANY CLAIM MADE BY A THIRD PARTY OR MADE BY YOU FOR A THIRD PARTY.

THIS LIMITATION OF LIABLITY APPLIES WHETHER DAMAGES ARE SOUGHT, OR A CLAIM MADE, UNDER THIS LIMITED WARRANTY OR AS A TORT CLAIM (INCLUDING NEGLEGENCE AND STRICT PRODUCT LIABLITY), A CONTRACT CLAIM, OR ANY OTHER CLAIM. THIS LIMITATION OF LIABLITY CANNOT BE WAIVED OR AMENDED BY ANY PERSON. THIS LIMITATION OF LIABLITY WILL BE EFFECTIVE EVEN IF YOU HAVE ADVISED RCS OR AN AUTHORIZED REPRESENTATIVE OF RCS OF THE POSSIBLITY OF ANY SUCH DAMAGES.

SOFTWARE

If your new RCS computer came with a Windows Operating System installed, RCS will give you support for the term of this Limited Warranty on the original Windows Operating System. Support is defined as assistance with questions and issues about the operating system. Questions can be submitted via the internet at:

RCS does not warrant software products, including any software products or the operating system preinstalled on your RCS computer. All software included with your RCS computer are provided “AS IS”. Sometimes issues arise, and conflicts occur between software programs. RCS is not the writer or manufacturer of software, therefore these types of issues are out of our control and are not covered under any warranty by RCS. However, often the manufacturers, suppliers, or publishers of the software may provide their own warranties directly to you, as well as direct support.
